6.A) Conditional Use Permit #12-21 for Hollow Road Solar, LLC - (Mr. Klein)

    Property Owner (Shawnee Magisterial District) Over the past several months, President Biden has been commenting on climate change and clean energy. Among the clean energy fuels are wind energy, hydro energy, geothermal energy, bioenergy, nuclear energy and solar energy. These energies are reusable resources. Building the solar farm will continue this concept. With a right of way across my farm, Hollow Road Solar will build a conduit to connect the energy produced to the Substation located near my property. Along with a conservation easement to the county, it's a win-win situation. 135 +/- acres will be used for the solar farm and 100 +/- acres will be left to allow the indigenous animals to feed, sleep and nuture their young. Auto makers are currently building electric vehicles. One auto maker has built a plant totally committed to building
    electric trucks. Currently there are several places to offer "plug-in" options for electric fuel. As our demand for electricity grows so does our ability to meet that demand. Solar farms are a way to gather a resource without excessive noise and pollution. Hollow Road Solar will be paying more in taxes. These taxes can be used to police, emergency personnel and buy fire equipment. This is good for the county by removing a burden of finding other resources to help elevate pressure from constituents. My farm has been in existence for over 200 years, and I want to continue that legacy. The solar energy project will allow that to happen. After construction, my property will be a peaceful place. My cousins currently plant some of my fields for crops used to feed livestock to be sold at the animal auction for people to buy for butchering. A local farmer uses my property for pasture land for the same purpose. In regards to crime, the Hollow Road property is maintained on a regular basis and has security cameras positioned to watch traffic entering and leaving the property. In closing, I support the Hollow Road Solar facility.

    The concerned citizens of Whitham Orchards (Gainesboro Magisterial District) oppose Hollow Road Solar LLC's solar project. Although the project is still in litigation, in June 2021, Hollow Road Solar, LLC, finalized the purchase of the property previously owned by National Fruit Orchards, Inc., proceeding with the planned solar project. We, the residents of Whitham Orchards are outraged. Hollow Road Solar, LLC, et al, insist on establishing its solar project adjacent to a community where families dwell.

    Since this case is currently in litigation and Hollow Road Solar LLC has already purchased the property; we understand that there is a possibility that this project may eventually be approved. If this project is approved, Hollow Road Solar, LLC, et al, must enter into a contract with adjacent property owners. The contract will outline Hollow Road Solar, LLC’s commitment to safety as a good neighbor. If our water quality, air quality, or soil quality becomes contaminated; or a resident becomes ill due to toxin exposure, Hollow Road Solar, LLC, et al, will take full responsibility for all that their enterprise will expose to this community. You will not put our peace, health, and wellbeing in jeopardy for your own financial gain.
    Today, the good citizens of Whitham Orchards serve notice to Hollow Road Solar, LLC, et al, and the Frederick County Board of Supervisors that we will hold Hollow Road Solar, LLC, et al, accountable for all that their enterprise exposes to our community.

    Therefore, we appeal to the Board that concerns that will be outlined in our forthcoming petition be addressed before reconsidering the project’s approval.

    Whitham Orchards is an enclave of homes located in Gore, Virginia (Gainesboro Magisterial District), on Timber Ridge Mountain, situated on Parishville Road, Anchorage Lane, and Welbourne Lane. As residents of this mountain community we enjoy our rural lifestyle and our stunning mountain views. We enjoy clean water, fresh air, and rich soil. We enjoy the quaint charm of the nearby farms, lush green corn fields, and the apple orchards that surround us. We don't want a single solar panel obstructing our mountain views.

    The residents of Whitham Orchards appeal the Board to consider that Gore, Virginia currently has the Unimim Corporation mine on Sand Mine Road. We also have an electrical power plant on Parishville Road. The proposed 300+ acre solar project would turn Whitham Orchards into an industrial waste-land. This project would have absolutely no benefit to our community. There is enough commercial-use land, not adjacent to residential communities, throughout the Commonwealth for such an enterprise. The residents of Whitham Orchards do not want this. Personal gain should never jeopardize the peace, health, safety, and well-being of an established neighboring community.

    Gainesboro District, 157 Anchorage Lane, Gore, Va. Shame on you Hollow Road Solar LLC! This project exemplifies thier GREED! Residents of the community you will impact do not want this project in our neighborhood! After they were denied, they sued the County, and while this case is still in litigation they went ahead and purchased the land without knowing the outcome of this litigation or arbitration is adjacent neighbors. That's their own fault!

    Agriculture is the gemstone of the Commonwealth. All over America, agricultural land is being sub-divided and sold to cooperation’s like Hollow Road Solar, LLC, that have no regard to the communities they disrupt. As residents of Frederick County, we petition the Board to restrict the re-zoning and sub-division of agricultural land near our community; because personal gain should never jeopardize the peace, health, safety and well-being of an established neighboring community. Residents of Whitham Orchards do not want to become an industrial waste land, or the victim of urban sprawl, and countless sub-divisions. Eventually, this kind of over-development will result in crime and the numerous problems we see in Northern Virginia.

    Gainesboro District, 156 Anchorage Lane, Gore, VA, one of the homes most impacted by this project. This project was already denied once. I don't see anything different that changes any of the reasons it was denied originally. The proposed landscape screening is woefully insufficient. It is too close to our property line. There are already other solar projects approved in the county and we do not know the impact of them, so why approve a third? This project does not benefit anyone other than the corporation. It will destroy our property value that we have worked hard to improve the last 14 years. It will destroy the scenic views and wildlife habitats that currently exist. This is merely a money-making opportunity for a company based outside our area to come in and drastically alter our landscape to our detriment. They do not live anywhere near the impacted area and do not have to deal with any of the negative consequences of this proposal. We do not want this anywhere near our property and we do not want to see a single solar panel affecting our scenic views. The landscape screening next to our property line will not block the sight of anything. They already have proved they will not be a good neighbor since they filed a baseless lawsuit when they did not get their desired outcome originally. I would hope our county officials would not approve a project from a company whose values are to sue when they do not get their way. This proposal was rejected 6-1 by the board of supervisors earlier in the year so why would the planning commission allow the same project to be approved again? Now is not the time to approve a solar farm project that does not benefit any of the residents or landowners and will only negatively impact the county's citizens of this area.
