12.A) Conditional Use Permit #02-21 for Eli Williams Submitted for Establishment of a Special Event Facility in the RA (Rural Areas) Zoning District.  The Property is Located at 1570 Gough Road, Winchester, Virginia and is Identified with Property Identification Number 60-A-79 in the Back Creek Magisterial District.

    I am in support of Eli Williams for the proposed venue on Gough Road. From some negative comments that have been posted it is clear that there has been little research done. VDOT has stated that any traffic from events would not disrupt the current traffic pattern and has made their stamp of approval. From my travels on Gough Road, there is plenty of room for two cars to pass safely.

    Those who either watched or attended the previous meeting were able to voice their opinions on the amount of amplified music. The regulations in place state that have no amplified sound outside and very little in the venue itself so not to disrupt the close neighbors, who have shown their support. The regulations already placed make it to where it is not going to affect close or near by neighbors so this should not be an issue.

    The barn is not viewable from Cedar Creek Grade, it would not disrupt any views. There are plenty of trees and landscape around to be able to mute any noise and there are regulations set with greatly reduced noise at 9pm and lights out at midnight.

    I can see in one opposing comment that states Eli does not plan to live on the property and claims that he has two rentals. This is a false statement! Eli plans to live on the property when his house is completed. This only proves that many will spew lies only to achieve their own agendas.

    Eli should be given the same opportunities as others and not be limited to however many events he can hold a year, etc.

    I am a resident of the Back Creek District and I live within two miles of the proposed venue. I support Eli Williams' application for a CUP to operate the venue. Eli has worked over the past year to meet all of the requirements set forth by Frederick County . As a responsible business owner, I believe Eli will follow all of the rules and regulations within the CUP. The venue will give people another choice for holding events in a beautiful country setting.

    In response to the comment about traffic on Gough Road, VDOT has approved the traffic pattern on Gough Road, as well as, traffic entering the venue. I have traveled Gough Road many times and there is plenty of room for two cars to pass each other. No one has to stop to do so. The comment that Eli has two VRBO type rentals on the property is inaccurate. He plans to live on the property once the construction of the house is complete. I'm not sure of the motives of people who comment false information and they should do their research before commenting.

    We live on Whistlewood Lane in the Royal Oaks subdivision which is within a half of a mile to the property and are opposed to the application for an Event Venue on 1570 Gough Rd. as applied for by Eli Williams. I am unable to attend due to health reasons but still want our voices to be heard. I have been in the residential real estate profession for over 40 years and traffic and noise are the biggest detriments to real estate values of the surrounding properties. Not only are there several homes built in the $400,000 to $1,000,000 range in close vicinity the proposed Event Venue but there several homesites on the market. If this application is approved, you will negatively affect all of the neighbor’s property so that one person can gain.

    Regarding traffic, Gough Rd is way too narrow to have 2 cars traveling in opposite directions pass one another without one pulling over and stopping and the intersection of Gough Rd. and Cedar Creek Grade is dangerous with cars turning left on Gough Rd having to pull out on Cedar Creek in order to see around the corner and the telephone pole with surrounding brush. If a car/truck is coming South over the hill, it’s too late to pull back.
    With Marker Miller Orchards and the bicycle riders on Cedar Creek Grade it’s becoming a dangerous road particularly when hundreds of vehicles must cross a double yellow line in order to pass a bicycle or multiple bicycles --- adding 50-100 cars is not a solution, its adding to an already dangerous situation.

    We purchased the Preservation Lot of 25 acres in order to have “quiet enjoyment” and planted over 200 trees and shrubs for aesthetics and to reduce the noise we don’t need another event venue in a rural residential area.

    With a landscaping business on this property and on an adjoining property a planned bed and breakfast as I have heard-- it all does not fit into a nice quiet residential area.

    Enough is enough stop the application now.

    We live on an adjoining property and we don’t think having a few events will adversely affect anything. We believe all the requirements and rules will be responsibly followed.

    I am the owner of Lot #2 on Laurel Grove and currently attempting to sell it as a residential property as is consistent with the current use of other properties in the area. I am very concerned with the way that sound travels in this area. As this CUP is noted as being filed for in response to a previous violation, I am NOT confident that other ordinances will be consistantly respected going forward either.

    The initial request, as well as the health department's recommendation for approval are based on hosting very few events, however the CUP does not put any limit on the number of events hosted. Wedding venues are currently more overbooked than ever and this CUP does nothing to prevent events being hosted 3 nights per week.

    While this may be beneficial for the single property, it seems it will have adverse effects on the value and tranquility of all surrounding properties and homes.

    The venue approval for a 'couple' wedding type events to go along with Eli's two VRBO type rentals (he does Not live there) will have continuous adverse effects on my adjoining property. Even though he's only asking for a 'couple' of wedding type events you seem to be granting him the ability to host events 365 days of the year. I own and am trying to sell multiple lots (on the Potty End of the venue) starting at 310' to the south. These lots will soon be home to million dollar houses. Is the barn insulted or sound proof? Unlike other event centers in the county, this barn is not by any means in the middle of a large tract of land. There is no way to hide 150 vehicles and the comings and goings, headlights, noise, etc. will be even more offensive to the rural landscape and property owners. Please give this considerable thought, as if you lived next door, as approval will destroy such a peaceful, scenic residential area of Frederick County.
