12.A) Rezoning #02-22 of R&J Land Development, LLC Submitted to Rezone 1.444-Acres from B3 (Industrial Transition) District to B2 (General Business) District with Proffers and 15.444-Acres from B3 (Industrial Transition) District to B3 (Industrial Transition) District with Amended Proffers. The Properties are Located Northwest Corner at Intersection of Martinsburg Pike (Route 11) and Jeff’s Way, and are Identified by Property Identification Numbers 33-A-122A, 33-A-123, 33-A-123C, 33-A-123D and 33-A-123E in the Stonewall Magisterial District.
Mr. Jenkins has failed to install the currently proffered evergreen screen to meet the requirements of his previously approved zoning amendment application. In addition to never installing the proffered x-tra evergreens, Mr. Jenkins has been in non-compliance with current zoning for years by utilizing the 15.4 acres for business vehicles & industrial storage w/out an approved plan or installing any screening. It's been an unsightly eyesore to the surrounding properties & negatively impacted the value of the historic residence located to its south. Ms. Nickerson contacted Mr. Jenkins in 2021 to inquire when the additional evergreen screening would be installed & he stated "not anytime soon."
He's been reported to the planning & zoning department, but to date hasn't complied w/ the proffers. We request that the current proffers are met prior to the approval of any additional rezoning applications. There's no evidence of good faith on the part of Mr. Jenkins given his continued apparent disrespect and disregard for legal processes.
As noted, the Comprehensive Plan serves as the community’s guide for making decisions re: development. The plan also states we should “develop a strategy that promotes the expansion of the following business and industrial land uses in the county:

•Light Industrial (Plastics & Metals)
•Food Processing (Organic, Beverages, Packaged, Perishable)
•Life Science (Pharm & Med Manufacturing, Scientific R&D, Lab Services)
•Business Services
• Retail (Restaurants, Apparel, Entertainment)
Additional Recommended Target Areas:
• Federal & State Facilities
• Healthcare & Health Services
• Lodging / Event / Dining
• Vineyard, Wineries, Micro-Breweries / Distilleries
We request that one of the above uses be considered prior to a DG to ensure consistency w/ the plan’s stated strategy of promoting the above listed uses; all of which would provide a greater positive economic impact to the county.
