8) County Officials

8.A) County Administrator's Report: Options to Address the Vacancy of the Chairman’s and the Gainesboro District Seats   Discussion/Action Items/Proposed Timeline:   a. Selection of a date for the special election.     b. Approval of a resolution authorizing the County Attorney to file a petition for Writ of Special Election with the circuit court to fill both vacant positions.   c. Application process and application deadline for receiving information from prospective candidates for (1) the Chairman's Seat, and (2) the Gainesboro Seat   d. The application period for both vacancies could be open from September 11-24, 2025, allowing 14 days to receive applications.   e.  The Board could hold a public meeting on October 1, 2025, to announce the applicants and make the applications available for public inspection. The Board should specify the nature of this meeting (such as whether applicants will be allowed to speak or simply have their names stated).    f. The Board could make the appointment at the regularly scheduled October 8, 2025, meeting. (If desired, the Board could hold a closed session to discuss prospective candidates immediately before the October 8 meeting.)   g. This proposed timeline would leave October 15th available for a special meeting, if needed.         Updated Board Committee Assignments

8.B) Supervisor Dunn requests that the Board schedule the following: - A Work Session to discuss salary compensation for constitutional officers - A Work Session with County Stakeholders to discuss Transfer of Development Rights - A Legislative Work Session (late September or October) with Delegates Wiley and Oates and Senator French

10.A) The Finance/Audit Committee charter adopted by the Board of Supervisors requires an annual review and reassessment.   The committee recommends no changes to the current charter.

12.A) Rezoning #04-25 of Laurel Ridge Community College Foundation Inc. (MDP Facilities Solutions) to Rezone 19.81+/- Acres from RA (Rural Areas) Zoning District to HE (Higher Education) Zoning District with Proffers for a Technical Trade Facility.  The Property is Generally Located Northeast of 131 Garland Snapp Drive, Middletown and is Identified by Property Identification Number 91-A-99B in the Back Creek Magisterial District.

13) Planning Commission Business - Other Planning Business

13.A) Action Item - Draft 2232 Policy   This is a draft policy for the consistent management of items required for review under VA §15.2- 2232. Staff recommends adoption of policy governing the review of items that fall under VA § 15.2-2232. Adoption of this policy will provide for consistency in handling 2232 items and provide applicants with a clear understanding of process and expectations.

13.B) Information/Discussion: Ordinance Amendment - Outdoor Lighting Standards    This is a proposal to amend Chapter 165 - Zoning Ordinance to amend supplementary use regulations for outdoor lighting contained in §165-201.07. The purpose of this amendment is to “modernize” outdoor lighting standards, review illumination levels, photometric plan requirements and incorporated LED lighting standards into the ordinance. This ordinance amendment was initiated by staff at the request of the Board of Supervisors.

13.C) Information/Discussion: Ordinance Amendment - R4 District Standard (Residential Planned Community District)   This is a proposal to amend Chapter 165 - Zoning Ordinance to amend design requirements contained in §165-501.06 for the R4 (Residential Planned Community) Zoning District to remove the minimum size required and amend the residential density requirements.
