12.C) Conditional Use Permit #03-25 of Ehsan Yousefie (Famili Ventures, LLC.) for a Farm Market and an Event Center on 45.96+/-Acres. The Property is Located at 686 Shady Elm Road, Winchester and is Identified by Property Identification Number 74-A-67 in the Back Creek Magisterial District.
Dear Board Members,
I understand there is a noise covenant with Hockman Ct residents- between kitty Hockman and Hockman court.
That alone should end the EC CUP for an event center. Why does it not?
1-Reference to change of live/amplified music from 10pm-9pm.
Unwelcomed Amplified music drifting into our dining times is intrusive.
Appears applicant wants compromise: 15 hours to 14 hours - this is not in spirit of compromise.
12 pm to 6 pm if amplified music must be.
2- too many grills/porta-pots- eyesores on land bordering residential use.
Porta-pots Some porta pots will be permanent- daily picnic opportunities. Poor conceived waste management for this.
We do not need another EC in Back creek district. Back Creek constituents should not bear the burden of this poorly conceived business plan- only 2 employees to run event hosting 150. There’s a lot of trash to clean up- will constituents be doing that as it blows into our yards?
Residential constituents count; pls treat us equal.
I am writing this to communicate my strong opposition to this CUP. My wife, three children and I live at 130 Hockman Ct, which is a neighboring property that shares a fence line with the proposed site. This proposal will present a significant negative impact to the general well-being of my family and our quality of life.
We moved into our home on Hockman Ct in 2020 looking for a place where we could raise our children that was quiet and provided open space for them to play. The quality of life that we have as homeowners raising our family will be significantly degraded with the introduction of an events center at this property that shares a fence line with our backyard. Late nights with amplified music and large crowds will completely disrupt the time that we spend as a family, and will impact our work, school, and athletic endeavors. My children will not be comfortable and I fear for their safety and well-being as they play outside in our backyard and at our pool while prospective attendees at an event center, potentially imbibing in alcoholic beverages, watch from the fence. This disruption to our lives, and that of our neighbors, is not what this area was designed for when the neighborhood was established.
Additionally, this proposal was so poorly presented at the public hearing for the Planning Commission that I have zero confidence in the owner’s ability to follow regulations and procedures while attempting to manage a business. He has no business plan to integrate several disjointed activities, no experience as a farmer or agricultural business owner, and no organizational structure to manage the operation or its customers (two proposed employees).
The proposed CUP will adversely affect the use and enjoyment of all surrounding properties, including my family’s residence. The owner’s lack of planning, as demonstrated with the Planning Commission, is evidence that he will be unable to mitigate the impacts of noise and traffic volume.
Back Creek District
I live at 113 Hockman Ct. I strongly oppose this conditional use permit. This proposal is fundamentally incompatible with the existing character of our area. Our neighborhood consists of family homes, quiet roads, and open space where our children can safely play outside. As a parent to two young children, the safety and quiet are two of the main reasons we purchased our home in this area five years ago. There is no buffer between our street and the farm. The farm is located directly next to our homes, children, and community. The environmental and health concerns are serious and unavoidable. Slaughterhouses generate significant waste, including blood, animal byproducts, and wastewater that can seep into the soil and local water sources. We all have wells. The impact will be seen in our water. Our roads are not built for this level of traffic, and with children, cyclists, and pedestrians using these streets daily, this creates an unacceptable safety risk. As a parent, I am deeply concerned about the increased danger this poses to my own children and the many others who live on our street. The event center will bring excessive noise and activity well into the evening, further disrupting our community. With events running from 7:00 AM until 10:00 PM, residents—many of whom have young children—will be subjected to loud music, crowds, and additional traffic late into the night. Property values will decline, and our neighborhood will be permanently changed. The presence of such a facility negatively impacts the desirability of a neighborhood, making it harder for families to sell their homes or maintain their property’s value. For those of us who have invested our time, money, and love into our homes, this is about protecting the safe, quiet quality of life that drew us to this community in the first place.
I urge you to consider the long-term consequences of allowing this permit. The families who live here will bear burden of these negative impacts every single day.
